As enforcement expectations continue to shift, reporting entities must keep pace with how FINTRAC assesses and penalizes non-compliance. Recent legislative change, including updates to administrative monetary penalty (AMP) thresholds and the evolving interpretation of program effectiveness, signal a more structured and, in some cases, more consequential enforcement environment.

This session will unpack what these changes mean in practice for AML/ATF compliance programs. Participants will gain insight into how violations are categorized, how penalties are calculated, and what trends are emerging from recent enforcement actions. Beyond understanding enforcement, the session will also explore when and how to critically assess examination finding, recognizing situations where clarification, additional context, or a formal challenge may be appropriate.

Through practical examples and lessons learned, the discussion will highlight common deficiencies identified in examinations and what distinguishes a compliant program from one that is merely documented. Attendees will also gain strategies for responding to findings in a way that is constructive, well-supported, and aligned with regulatory expectations.
