Canada’s AML regime is increasingly enforced through administrative penalties and regulatory action. But what happens when those decisions are challenged in court? Drawing on experience representing clients in complex AML investigations and litigation involving FINTRAC penalties, this session will explore how enforcement decisions are made, how they are challenged, and what reporting entities should understand about the legal risks of the AML framework. The presentation will highlight litigation strategies, procedural fairness issues and emerging trends in Canada.
